A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing detainment is without legal authority.
"Since his release after erroneous detention in El Salvador, he has been re-detained, again without legal justification," the judge stated in her order.
The case stems from a mistaken deportation to El Salvador earlier this year, which US authorities later admitted was an error. After his return to the United States to face alien smuggling allegations, he was held in federal detention.
In her order, the judge noted that the authorities does not have a valid removal order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."
